Introduction
These Terms govern your use of the Indi Travel Guide mobile application, website, and related services (the "Platform"). The Platform is operated by Indi Travel Guide Ltd, registered in England and Wales (Company No. 14479958), registered office at 11 Bridge Street, Bury, Lancashire, England, BL0 9AB. By accessing or using the Platform, you agree to these Terms.
Eligibility
You must be at least 16 years old to use the Platform. We do not knowingly allow users under the age of 16 to use the Platform. If you are under 18, you must have permission from a parent or legal guardian to use the Platform and to make any purchases. We may suspend or terminate accounts where false information is provided.
Account Registration & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. We may suspend accounts that breach these Terms.
Platform Services
The Platform provides travel discovery content, creator recommendations, journey planning tools, social features, live location sharing (Indi Trax), subscription features, digital exports, and photobook services via third-party providers.
Subscriptions & Payments
Premium features require paid subscriptions. Subscriptions may auto-renew unless cancelled before renewal. Purchases via Apple App Store or Google Play are subject to their respective terms.
Indi Trax (Live Location Sharing)
Indi Trax allows optional real-time location sharing. By activating Indi Trax, you accept the risks associated with sharing location data. Indi is not responsible for offline interactions or safety incidents.
User-Generated Content
You retain ownership of content you upload but grant Indi Travel Guide Ltd a worldwide, non-exclusive, royalty-free licence to use, host, reproduce, modify, and promote such content in connection with the Platform.
Privacy Controls, Content Visibility & User Responsibility
The Platform includes privacy controls that allow users to manage the visibility of certain profile elements and activities.
Visibility Settings
The Platform may allow users to adjust visibility settings such as "Followers Only" or "Private Profile". These settings apply only to designated profile elements as defined within the Platform interface and do not apply universally to all content.
Public Content
Content shared in public areas (including feeds, public journeys, comments, or creator posts) may remain visible to other users. Public content may appear in feeds, search results, or recommendations within the Platform.
Content Permanence
Other users may save, share, screenshot, or otherwise record publicly available content. Indi Travel Guide Ltd does not guarantee removal of third-party copies of content.
Location Features
Location-sharing features, including Indi Trax, operate independently from profile visibility settings. Users are responsible for activating or disabling location features and understanding who may view their location.
No Expectation of Absolute Privacy
The Platform is a social and community-based service. By sharing content within the Platform, users acknowledge that absolute confidentiality cannot be guaranteed.
Limitation of Liability Regarding Visibility
To the maximum extent permitted by law, Indi Travel Guide Ltd shall not be liable for visibility of content resulting from user-selected privacy settings, public sharing of content, third-party screenshots or redistribution, or misunderstanding of platform visibility features.
Acceptable Use
You must not upload illegal, harmful, infringing, or misleading content. We may remove content or suspend accounts at our discretion.
Travel & Offline Interaction Disclaimer
Travel recommendations are provided for general guidance only. Indi Travel Guide Ltd is not responsible for travel safety, visa requirements, third-party services, or offline meetings arranged through the Platform.
Intellectual Property
All Platform content (excluding user content) is owned by or licensed to Indi Travel Guide Ltd. You may not copy, scrape, reverse engineer, or commercially exploit Platform content without permission.
Limitation of Liability
To the maximum extent permitted by law, Indi Travel Guide Ltd shall not be liable for indirect, incidental, or consequential damages, including loss of profits, data, or business. Nothing excludes liability for fraud or death or personal injury caused by negligence.
Termination
We may suspend or terminate your account for breach of these Terms or safety concerns. You may delete your account at any time.
Governing Law
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
Creator Eligibility
Creator status is subject to approval. Indi Travel Guide Ltd may approve, reject, or revoke Creator status at its discretion.
Creator Responsibilities
Creators must provide authentic recommendations, comply with advertising standards, and disclose sponsored content clearly.
Sponsored Content & Disclosure
Creators are responsible for compliance with advertising and consumer protection laws, including ASA guidelines and equivalent international regulations.
Monetisation & Revenue
Where monetisation is enabled, payout structures will be communicated separately. Indi Travel Guide Ltd may suspend or withhold payments in cases of policy breaches or fraud.
Brand Partnerships
Indi Travel Guide Ltd may facilitate brand collaborations but does not guarantee brand payments unless contractually agreed.
Intellectual Property Licence
Creators grant Indi Travel Guide Ltd a licence to promote, market, and distribute creator content across media channels.
Public Nature of Creator Accounts
Creator accounts are public-facing by design.
By applying for and maintaining Creator status, you acknowledge and agree that:
- All Creator content is publicly visible within the Platform.
- Creator profiles are publicly accessible to all users.
- Creator content may appear in the Discover feed, recommendations, search results, promotional features, and other publicly accessible areas of the Platform.
- Creator accounts do not have privacy or restricted visibility settings.
Creators understand that participation as a Creator is intended to enable broad visibility and discoverability.
Creators further acknowledge that:
- Other users may share, save, interact with, or screenshot publicly available Creator content.
- Indi Travel Guide Ltd does not guarantee removal of third-party copies of content.
- Deleting or downgrading a Creator account does not guarantee removal of previously shared or distributed content.
To the maximum extent permitted by law, Indi Travel Guide Ltd shall not be liable for the public visibility or distribution of Creator content in accordance with Platform functionality.
Taxes & Legal Compliance
Creators are solely responsible for declaring income and paying applicable taxes in their jurisdiction.
No Employment Relationship
Creator status does not create an employment, partnership, or joint venture relationship.
Termination of Creator Status
We may remove Creator status for policy breaches or brand safety concerns.
